These Terms of Service (“Terms”) apply to your access to and use of websites, digital experiences, content, event activations/pop-ups and other services provided by Craftable Productions (“Craftable”, “we”, “us” or “our”), with its registered office in Busselton, Western Australia.

By accessing or using a Craftable website, digital experience or service, or registering for or participating in a Craftable event activation/pop-up, you agree to these Terms.

If you do not agree to these Terms, you should not use the relevant service or participate in the relevant event activation/pop-up.

Use of Craftable services is also subject to our Privacy Policy.

We may update these Terms from time to time as Craftable and its services evolve. The current version will be made available through the Craftable website.

1. ABOUT CRAFTABLE

1.1 Craftable is a creative platform and Design District exploring the intersection of art, sound, wellbeing, technology, design, making and physical space.

1.2 Craftable's current activities may include:

• websites and digital landing pages;

• digital artworks and creative content;

• Smart Codes and Knowledge Architectures;

• sound and frequency-based content;

• video and other media;

• community challenges and event activations/pop-ups;

• research, development and concept projects; and

• communications, mailing lists and other community initiatives.

1.3 Craftable also develops concepts and projects including The Art of Wellness, the Design District, Factory Grounds and the Neighbourhood.

Some of these projects are in research, development, planning or pre-launch stages. References to future projects, proposed features, spaces or services do not constitute a representation or guarantee that they will be developed, opened, released or delivered in any particular form or timeframe.

2. USE OF CRAFTABLE SERVICES

2.1 You may use Craftable's publicly available websites and content for lawful, personal and non-commercial purposes unless otherwise stated.

2.2 Certain experiences, event activations/pop-ups or services may have additional eligibility requirements, participation rules, fees or terms. Where additional terms apply, they will be communicated to you in connection with that particular experience.

2.3 You must not:

• use Craftable services for unlawful or fraudulent purposes;

• interfere with the operation or security of a Craftable website or digital service;

• attempt to gain unauthorised access to restricted systems, materials or content;

• copy, extract, reproduce or commercially exploit protected Craftable material except as permitted by law or with our written permission;

• impersonate another person or provide deliberately false information; or

• use Craftable services in a way that infringes the rights of another person.

3. DIGITAL CONTENT, ARTWORKS, SMART CODES AND SOUND

3.1 Craftable may publish or make available digital artworks, videos, sound recordings, sound healing tones, Smart Codes, Knowledge Architectures, written material and other creative content.

3.2 This content is provided for creative, artistic, informational and general wellbeing purposes.

3.3 References to frequencies, energy, alignment, consciousness, Smart Codes, healing, wellbeing or similar concepts describe Craftable's creative and conceptual framework. They should not be interpreted as medical, psychological, therapeutic or scientific advice or as a guarantee of any particular health or wellbeing outcome.

3.4 Craftable content is not a substitute for professional medical, psychological or other healthcare advice, diagnosis or treatment.

3.5 You are responsible for deciding how and whether you engage with Craftable content.

4. EVENT ACTIVATIONS/POP-UPS, CHALLENGES AND PARTICIPATION

4.1 Craftable may create, promote or facilitate creative experiences, walking challenges and other physical or community event activations/pop-ups.

4.2 An event activation/pop-up may take place across public spaces, privately operated venues or other locations that are not owned, operated or controlled by Craftable.

4.3 Unless expressly stated otherwise, Craftable's involvement in an event activation/pop-up does not mean that Craftable owns, manages or controls the location in which a participant chooses to undertake the activity.

4.4 Participants are responsible for:

• determining whether they are physically able to participate safely;

• choosing appropriate locations, routes, times and conditions;

• remaining aware of traffic, weather, terrain, surroundings and other hazards;

• complying with applicable laws and the rules or conditions of any venue or location;

• using appropriate equipment, clothing or footwear where relevant; and

• stopping or modifying participation where they consider it necessary for their safety or wellbeing.

4.5 Participation in physical activities involves ordinary risks associated with movement and the environment in which the activity is undertaken. Participants accept responsibility for their own participation and personal decisions, subject always to rights and protections that cannot lawfully be excluded.

4.6 If you have concerns about whether an activity is appropriate for your circumstances, you should seek appropriate professional advice before participating.

4.7 Craftable may establish additional rules for individual event activations/pop-ups, including participation periods, completion requirements, entry fees or commitments, prize pools, verification requirements and eligibility criteria. Those rules form part of these Terms for participants in that event activation/pop-up.

5. THIRD-PARTY SERVICES AND LOCATIONS

5.1 Craftable may use or link to third-party platforms, applications, payment services, social media platforms, venues and other services.

These may include third-party activity-tracking platforms used in connection with Craftable event activations/pop-ups.

5.2 Third-party services are operated independently of Craftable and may have their own terms, privacy policies, eligibility requirements and technical requirements.

5.3 Your use of a third-party service is subject to the terms and policies of that provider.

5.4 Craftable does not control and is not responsible for the availability, security, operation or independent conduct of third-party platforms or services, except to the extent responsibility cannot lawfully be excluded.

5.5 Where an event activation/pop-up involves access to a third-party venue, attraction or property, participants must comply with that operator's entry conditions, safety requirements and other applicable rules.

6. FEES, CHALLENGES AND PRIZE POOLS

6.1 Some Craftable event activations/pop-ups or services may require payment of an entry fee, participation fee, commitment amount or other charge.

6.2 The price and applicable payment conditions will be disclosed before participation.

6.3 Certain event activations/pop-ups may use a commitment or prize-pool model. Where applicable, the specific rules governing completion, eligibility, verification, return of commitments and distribution of a prize pool will be provided with the event activation/pop-up.

6.4 Participants are responsible for understanding the applicable rules before entering.

6.5 Craftable may disqualify entries involving fraud, falsified activity, manipulation of tracking systems or other conduct inconsistent with the applicable challenge rules.

6.6 Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.

7. INTELLECTUAL PROPERTY

7.1 Unless otherwise indicated, Craftable's branding, written material, graphics, designs, website content, Smart Codes, Knowledge Architectures, system architecture, original artworks, audiovisual content and other original materials are owned by or licensed to Craftable and are protected by applicable intellectual property laws.

7.2 Creator Rights. Artists, sound designers, photographers and other collaborators may retain ownership of their original works. Where third-party works appear within a Craftable experience, they are used under the relevant permission, licence or agreement.

7.3 Craftable Materials. Smart Codes and Craftable's original Knowledge Architecture structures, written expressions, visual systems and associated proprietary materials created by Craftable remain the intellectual property of Craftable Productions unless expressly agreed otherwise in writing.

7.4 Access to Craftable content does not transfer ownership of that content or any associated intellectual property rights to you.

7.5 Unless permitted by law or expressly authorised in writing, you must not reproduce, distribute, sell, license, adapt, commercially exploit or represent Craftable proprietary material as your own.

7.6 You may share links to publicly accessible Craftable content and services provided you do not misrepresent your relationship with Craftable.

8. USER SUBMISSIONS AND COMMUNICATIONS

8.1 Where you provide information to Craftable — including through a contact form, mailing list, challenge registration or other communication — you must provide information that is accurate to the best of your knowledge.

8.2 Personal information provided to Craftable will be handled in accordance with our Privacy Policy.

8.3 If you subscribe to Craftable communications, you may unsubscribe from marketing communications using the method provided in those communications.

9. AVAILABILITY AND CHANGES

9.1 Craftable is an evolving platform. We may add, modify, suspend or discontinue websites, content, features, event activations/pop-ups, research projects or services.

9.2 We do not guarantee that any particular website, page, project, event activation/pop-up, feature or piece of content will remain available indefinitely.

9.3 Information relating to projects in development — including Factory Grounds, the Neighbourhood, the Design District and The Art of Wellness — may change as research, planning, design and development progress.

10. DISCLAIMERS

10.1 Craftable content is provided for creative, artistic, informational and general wellbeing purposes unless expressly stated otherwise.

10.2 Craftable does not provide medical, psychological, financial, legal or other professional advice through its general content.

10.3 Individual experiences of artworks, sound, Smart Codes, event activations/pop-ups and wellbeing content will vary. Craftable does not guarantee particular physical, emotional, financial, creative or other outcomes.

10.4 While we take reasonable care in providing our services, websites and content may occasionally contain errors or experience interruptions.

11. AUSTRALIAN CONSUMER LAW

11.1 Nothing in these Terms is intended to exclude, restrict or modify rights, guarantees, warranties or remedies that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.

11.2 Where Craftable supplies goods or services to a consumer, statutory consumer guarantees may apply in addition to these Terms.

12. LIMITATION OF LIABILITY

12.1 To the maximum extent permitted by law, Craftable is not liable for loss or damage arising from:

• a participant's failure to exercise reasonable care during an event activation/pop-up;

• conditions, hazards or incidents occurring at locations not controlled by Craftable;

• the independent acts or omissions of third-party service providers, venues or platform operators;

• unauthorised or improper use of Craftable content; or

• reliance on Craftable content as medical, psychological or other professional advice.

12.2 Nothing in this section limits liability where doing so would be unlawful, including liability or remedies that cannot be excluded under the Australian Consumer Law.

13. SUSPENSION OR TERMINATION

13.1 Craftable may restrict access to a service, event activation/pop-up or community experience where a person:

• breaches these Terms or applicable event activation/pop-up rules;

• engages in fraudulent, abusive, threatening or harmful behaviour;

• infringes intellectual property rights;

• attempts to compromise Craftable systems or services; or

• materially interferes with another person's ability to participate safely.

13.2 Where appropriate, Craftable may also disqualify a participant from a particular challenge or event activation/pop-up in accordance with its published rules.

14. LINKS AND EXTERNAL CONTENT

14.1 Craftable websites and communications may contain links to third-party websites, platforms or resources.

14.2 A link does not necessarily constitute endorsement of the third party or its products or services.

14.3 Third-party websites and services operate independently and are subject to their own terms and privacy practices.

15. CHANGES TO THESE TERMS

15.1 We may update these Terms where Craftable's activities, services, technology or legal obligations change.

15.2 The current version and effective date will be published on the Craftable website.

15.3 Where a change materially affects an existing paid service or event activation/pop-up, we will take reasonable steps to communicate the change where appropriate.

16. GOVERNING LAW

These Terms are governed by the laws of Western Australia, Australia.

You and Craftable submit to the jurisdiction of the courts of Western Australia and any courts entitled to hear appeals from those courts.
